Understanding Exclusive Listings & Benefits

In some countries like Thailand, exclusive listings are not as common as the United States. One reason for that is the real estate agencies and regulations in Thailand are not a mature eco-system but it is gradually changing. As more and more people are looking for real estate agencies to represent their homes, businesses and franchises, more and more brokers are introducing the concept of exclusivity to the sellers. However, there is still a confusion as the difference between a " Exclusive Property Listing with an agency " and " Exclusive Agency's right to sell a property". This must becomes clear for both sellers and also for new agents.

" Exclusive Property Listing With an Agency "

This means that a seller lists a home, condo, land, business, franchise for rent or sell through one agency. In return, the agency will dedicate its time, money and resources to focus on selling the listing. Any buyers that is introduced to the seller, through the exclusive agency, entitles the agency to be paid a commission. However, if the owner finds someone on his/her own, the agency is not subject to a commission.

" Exclusive Agency's Right to Sell a Property"

Compared to the previous definition, the Exclusive Agency's Right, allows the agency to collect commission on the sale or rent of a property no matter who brings a willing buyer to the table. This means, if the seller decides to sell a property to a family member during the term of the agreement with an agency, the seller is subject to pay a commission to the agent.
